1. About These Terms
These Terms of Service ("Terms") govern your use of the website at www.urbanwebcreation.com and any services provided by Urban Web Creation ("we", "us", "our"), based in Partaloa, Almeria, Spain.
By engaging our services or submitting an enquiry, you agree to these Terms. If you do not agree, please do not use our services.
2. Our Services
Urban Web Creation provides the following services:
- Custom website design and development
- Web hosting
- Domain setup and management assistance
- SEO optimisation
- Website maintenance and support
The exact scope of services for each client is agreed in writing (email or proposal) before work begins.
3. The Free Website Offer
We offer a free website build to clients who sign up for one of our hosting plans. The following conditions apply:
- The free website build is included at no additional cost when you subscribe to and maintain a paid hosting plan with Urban Web Creation
- The scope of the free build (number of pages, features) is determined by the hosting plan selected — see our Pricing page
- If you cancel your hosting plan within the first 12 months, a website build fee will become payable. This fee will be agreed in writing before your project starts
- After 12 consecutive months of paid hosting, full ownership of the website files passes to you at no additional cost
- We reserve the right to withdraw or modify the free website offer at any time for new clients, but this will not affect existing agreements
4. Hosting Services
- Hosting is billed monthly in advance. Fees are as listed on our Pricing page at the time of sign-up
- We aim for 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible
- You are responsible for ensuring that content hosted on your website complies with all applicable laws
- We reserve the right to suspend hosting immediately if your site is found to host illegal content, malware, spam, or material that infringes third-party rights
- Hosting fees may be reviewed annually. We will give at least 30 days' written notice of any price change
5. Payment Terms
- Monthly hosting fees are due on the same date each month
- If payment is not received within 7 days of the due date, we reserve the right to suspend the hosting service
- If payment remains outstanding for 30 days, we reserve the right to terminate the account and delete associated files. We will give reasonable notice before doing so
- All prices are shown in Euros (€) and are exclusive of any applicable taxes unless stated otherwise
6. Your Responsibilities
As a client, you agree to:
- Provide accurate information when signing up and keep your contact details up to date
- Supply any content (text, images, logos) required for your website in a timely manner
- Ensure you have the rights to use any content you provide to us
- Not use our hosting services to distribute spam, illegal content, or malicious software
- Keep any account credentials secure and notify us immediately if you suspect unauthorised access
7. Intellectual Property
- All website designs, code, and creative work produced by Urban Web Creation remain our intellectual property until either full payment is received or the 12-month hosting threshold is met (for free-build clients)
- Any content you supply (text, images, logos) remains your property. By providing it to us, you grant us a licence to use it solely to build and maintain your website
- We reserve the right to display completed projects in our portfolio unless you specifically request otherwise in writing
- Stock images sourced by us are licensed for use in your website only and may not be extracted and used elsewhere without obtaining the appropriate licence
8. Cancellation
- You may cancel your hosting plan at any time by giving us 30 days' written notice by email
- No refunds are given for partially used months
- If you cancel within the first 12 months, the build fee described in Section 3 becomes payable before your account is closed and files are transferred
- After 12 months, cancellation is free and your website files will be provided to you upon request within 14 days
9. Limitation of Liability
To the fullest extent permitted by law:
- Urban Web Creation shall not be liable for any indirect, incidental, or consequential loss arising from use of our services
- Our total liability to you in connection with any services shall not exceed the total fees paid by you in the 3 months preceding the claim
- We are not liable for data loss caused by third-party hosting infrastructure failures, though we will take reasonable steps to maintain backups
10. Governing Law
These Terms are governed by the laws of Spain. Any disputes will be subject to the exclusive jurisdiction of the courts of Almeria, Spain, unless otherwise required by applicable consumer protection law in your country of residence.
11. Changes to These Terms
We may update these Terms from time to time. We will notify existing clients of material changes by email. The "Last updated" date at the top of this page will always reflect the most recent revision. Continued use of our services after changes are made constitutes acceptance of the new Terms.
